Public nuisances
What is a Public Nuisance?
Nuisance is an abandoned structure or an abandoned, barren or vacant lot, which is unfit for human habitation or use because it is in a dilapidated condition, unrepaired, defective in construction, or detrimental to the health or safety of the public.
Some conditions that cause a property to be declared a public nuisance include:
- Defects in the structure that increase the risk of fire or accidents;
- Lack of adequate ventilation or sanitary facilities;
- Lack of electricity or potable water;
- Lack of cleanliness.
No property is a nuisance until it has been declared as such.
Who can declare a property a public nuisance?
Municipal governments may declare any property within their territory that meets the above definition as a public nuisance.
